DEFINITIONS
"Provider" refers to Capture360, responsible for delivering the 360 photo booth service.
"Client" is the individual or entity that organizes the event, signs the contract, and makes the necessary payments.
"Patrons" are guests attending the Client's event.
OPERATIONAL GUARANTEE
The Provider commits to maintaining the 360 Booth operational for a minimum of 80% of the event duration, subject to necessary maintenance activities.
FINANCIAL AGREEMENT
The Client is required to make a non-refundable booking fee of $200.00 AUD to secure the event date. The full payment is due 7 days prior to the event. A 10% surcharge applies for late payments, and the Provider reserves the right to cancel the service for non-payment.
VENUE AND INTERNET REQUIREMENTS
The Client must ensure a minimum space of 3m x 3m for the 360 Booth and a power supply. Additionally, stable Wi-Fi with minimum speeds of 40mbps download and 12mbps upload is required. The Provider is not responsible for service issues due to inadequate internet speeds and will not bear costs for alternative internet solutions.
RESCHEDULING AND CANCELLATION
The Client may cancel with a refund of the booking fee within 7 days. Date changes require a written notice at least 20 days before the scheduled event and are subject to the Provider's availability. Late cancellations result in forfeiture of all payments.
TRAVEL AND PARKING
All travel and parking expenses for the Provider are included in the service packages.
INSURANCE AND LIABILITY
The Provider holds over $20,000,000 in liability insurance. Certificates are available upon request with a week's notice.
OUTDOOR EVENT CONDITIONS
For outdoor setups, the Provider requires a dry, sheltered area on a solid surface. The Provider reserves the right to terminate the service in unsafe conditions without refunds.
EQUIPMENT MANAGEMENT
The Client is responsible for any damage or loss to the Provider’s equipment due to misconduct by Patrons. The Provider may terminate services without refund in case of equipment damage or staff harassment.
POLICY FOR MINORS
Patrons under 12 must be supervised by an adult in the 360 Booth. This policy is enforced at the Provider's discretion.
INDEMNIFICATION
The Client agrees to indemnify the Provider against liabilities related to the event and the use of images taken during the event.
SERVICE DURATION AND EXTENSIONS
Setup occurs 40-60 minutes prior to the event. Additional idle hours and service extensions are available at an agreed hourly rate.
DRESS CODE
The Provider's team will dress appropriately for the event, considering any special attire requests from the Client.
PHOTOGRAPHY RIGHTS
The Client authorizes the Provider to use event photographs and videos. Objections must be communicated before the event.
PHOTO OVERLAY DESIGN
The Provider offers up to three free overlay design revisions. Additional revisions incur a $15 charge each.
CATERING FOR THE PROVIDER'S TEAM
For events exceeding 3 hours with meals, catering for the Provider's team is expected by the Client.
GUEST CONDUCT AND LIABILITY
The Provider is not liable for incidents due to Patrons disregarding safety instructions around the 360 camera. The Client is responsible for informing Patrons of safety protocols. The Provider reserves the right to refuse service to any Patron for safety concerns.
